DES MOINES, Iowa — The trial for a man who police say hit and killed a cyclist in August has been rescheduled.

Jonathan Leyva, 32, was charged with vehicular homicide by OWI after police say his blood alcohol level was nearly three times the legal limit when he hit 41-year-old Wade Franck on Aug. 16. Franck was riding with several other cyclists when he was hit. He died a few days later from his injuries.

Leyva pleaded not guilty. His trial was set to begin Feb. 8, but it has been rescheduled for April 4 at the Polk County Courthouse in Des Moines.

Velocio wonders, if, after serving his sentence, will he be deported to his country of origin??? He should be....
